Terms & Conditions
New Finish Plastering & Maintenance
Last updated: 28 September 2026
These Terms & Conditions explain the basis on which New Finish Plastering & Maintenance (“we”, “us” or “our”) provides services to its customers.
They should be read together with the individual quotation provided for the work. The quotation will set out the project-specific scope, price, payment arrangements, exclusions and any particular responsibilities agreed with the customer.
Where there is any difference between these general Terms & Conditions and something specifically agreed in writing within a quotation, the wording of the quotation will take priority for that project.
1. Quotations and Scope of Work
Our quotation will describe the work we have agreed to carry out and the price based on the information available and the visible condition of the property at the time the quotation is prepared.
Unless specifically included, quotations do not automatically include scaffolding, access equipment, skips, waste removal, permits, structural work, electrical work, plumbing, specialist works by other trades, decorating or making good outside the quoted work area.
A quotation is valid for the period stated on it. A proposed date or period is not reserved until the quotation has been accepted and any required booking deposit has been received.
2. Booking Deposits
Where a booking deposit is required, the amount will be stated in the quotation.
Payment of the deposit, together with acceptance of the quotation, secures the agreed work period subject to our confirmation.
The deposit forms part of the total contract price and will be deducted from the final amount payable.
Cancellation rights are explained below. A deposit will not automatically be treated as non-refundable where doing so would conflict with the customer's statutory rights or would result in an unfair cancellation charge. UK consumer guidance specifically warns against excessive cancellation charges and automatic loss of all upfront payments.
3. Customer Responsibilities
The customer must provide safe and reasonable access to the work area and, where required, access to water and electricity.
Any preparations allocated to the customer in the quotation must be completed before work begins. This may include removing existing finishes, furniture or fittings and arranging scaffolding, access equipment, skips, waste facilities or permits.
Unless we have specifically agreed otherwise in writing, the customer is responsible for obtaining any planning permission, listed-building consent, building-control approval, party-wall notices or other permissions required for the work.
If these arrangements are incomplete and prevent work from proceeding, the programme may need to be rearranged.
4. Scaffolding and Other Contractors
Where the customer appoints a scaffolder, skip provider or another contractor directly, that contractor is engaged by the customer rather than by New Finish Plastering & Maintenance.
Their charges remain the customer's responsibility.
We are not responsible for delay, damage or additional work caused by contractors whom we have not appointed or controlled, except where the law provides otherwise.
5. Existing and Hidden Conditions
Our quotation is based on conditions that can reasonably be identified before work begins.
Once existing plaster, render, coverings or other materials are removed, previously concealed problems may become apparent. These can include loose or defective backgrounds, damp, water ingress, unsuitable substrates, structural movement, damaged masonry, asbestos or other hidden defects.
Where an unforeseen condition materially affects the work, we will explain the issue and, where appropriate, agree any change to the price or programme before additional chargeable work proceeds.
We may carry out work immediately where reasonably necessary to make the site safe.
6. Variations and Additional Work
Any work outside the agreed scope will be treated as additional work.
Where possible, we will explain what is required and obtain the customer's written approval, including any additional charge, before proceeding.
A customer-requested change may also affect the estimated completion date.
7. Materials and Finishes
Natural materials including lime, mineral products, timber and similar materials may contain natural variations in colour, shade, texture or appearance.
Samples, photographs and previous projects are therefore indicative rather than a guarantee of an identical final appearance.
Materials will be selected and used in accordance with the agreed specification and, where applicable, relevant manufacturer guidance.
8. Start Dates, Programme and Delays
Start dates and completion periods are estimates unless we specifically agree otherwise in writing.
Building and finishing work can be affected by weather, temperature, drying and curing times, material availability, hidden conditions, delayed access, customer changes and work being carried out by other contractors.
This is particularly relevant to external rendering and lime work, where unsuitable weather or environmental conditions may make it inappropriate to continue.
We will keep the customer reasonably informed where there is a material change to the programme.
9. Payment
The quotation will specify the total price and any deposit or staged-payment arrangement.
Invoices must be paid by the due date shown on the invoice.
Where an undisputed payment becomes overdue, we may give notice and suspend further work until payment has been brought up to date.
For qualifying business-to-business debts, statutory interest and permitted recovery charges may apply.
Nothing in these terms removes a consumer's statutory rights.
10. Cancellation and the 14-Day Cooling-Off Period
Where statutory consumer cancellation rights apply to a contract entered into at a customer's home, at a distance or in another qualifying off-premises situation, the customer will normally have 14 days from the date the contract is entered into to cancel without giving a reason.
Where those rights apply, the customer will be provided with the required cancellation information in a form they can keep, such as by email or in writing. Government guidance states that the relevant information should be provided in a durable form rather than relying solely on a webpage.
If the customer asks us to begin work during the cancellation period, we may ask them to expressly confirm that request.
If the customer subsequently cancels after work has begun, they may be required to pay an appropriate amount for services already supplied, where permitted by law.
Where a service has been fully completed during the cancellation period following the required request and acknowledgement from the customer, the statutory right to cancel may end.
After any applicable cooling-off period has expired, if the customer cancels the work we may recover reasonable costs and losses resulting from the cancellation, including appropriate costs already incurred for materials or commitments made specifically for the project.
Any amount retained will be reasonable and proportionate rather than an automatic forfeiture of all sums paid.
11. Completion and Snagging
The customer should inspect the work at practical completion and tell us promptly about any concerns, preferably with photographs where appropriate.
Where reasonably possible, we should be given an opportunity to inspect and remedy an alleged workmanship defect before another contractor alters or repairs the affected work.
Minor snagging does not normally justify withholding payment for other completed and undisputed work.
This clause does not limit the customer's statutory rights.
12. Workmanship Warranty
New Finish Plastering & Maintenance provides a 12-month workmanship warranty from practical completion for defects caused by our workmanship.
Where a covered defect is reported during that period, we will inspect the issue and, where the warranty applies, put the workmanship right within a reasonable period.
The workmanship warranty does not cover malicious or accidental damage; damage caused by the customer, another trade or a third party; building movement, vibration, settlement or structural failure; water ingress, unresolved damp, condensation, leaks, flooding or weather damage; failure of an existing or unsuitable background or substrate not included within our work; normal drying, curing, shrinkage or minor hairline cracking that is not caused by defective workmanship; failure to follow reasonable care, ventilation, heating, drying or decorating advice; or defects in materials supplied by the customer except where caused by our failure to use reasonable care and skill when installing them.
The warranty is additional to the customer's statutory rights and does not replace them.
UK consumer law requires services to be carried out with reasonable care and skill and prevents a trader from contracting out of that obligation.
13. Damage and Liability
We will take reasonable care while carrying out the agreed work.
We are not responsible for pre-existing defects or for loss or damage caused by circumstances outside our reasonable control where we have not caused the problem.
Nothing in these Terms & Conditions excludes or restricts any liability that cannot legally be excluded or restricts a customer's rights under the Consumer Rights Act 2015 or other applicable consumer law.
14. Complaints
If a customer has a concern about our work, they should contact New Finish Plastering & Maintenance as soon as reasonably possible with details of the issue.
Where appropriate, we will arrange to inspect the work and discuss a reasonable solution.

15. Statutory Rights
Nothing within these Terms & Conditions affects a customer's statutory rights.
Consumer contract terms must be fair and transparent, and terms that attempt to remove statutory consumer protections may not be enforceable.
16. Changes to These Terms
We may update the general Terms & Conditions displayed on our website from time to time.
Changes will not retrospectively alter an existing contract. The terms applying to a particular project will be those incorporated into the agreement when that contract was entered into, together with any subsequent changes expressly agreed between us and the customer.
17. Governing Law
These Terms & Conditions and contracts entered into with New Finish Plastering & Maintenance are governed by the laws of England and Wales, subject to any mandatory rights available to consumers under applicable law.
